This privacy policy explains how Secure Data, Inc., Secure Data Recovery, LLC, and Secure Data Software, LLC (collectively, “Secure Data”, “we”, “us”, “our”, etc.) collects, shares, secures, and uses the personal information you provide on our websites (www.securedata.com, www.securedatarecovery.com), mobile apps, and through use of our services (including both free and paid). By using our websites, mobile apps, or services, you consent to the use of your personal information as described in this policy. Collecting and Using Personal Information; Obtaining Consent

“Personal information” is information that identifies you as an individual or relates to an identifiable individual. For example, personal information includes, but is not limited to: name; username; postal address; telephone number; email address; profile picture; social media account ID; and IP address. Situations where we may collect personal information include, but are not limited to:

• personal information entered into our online evaluation form or collected over the phone when someone calls our customer service department
• personal information sent to us in a request regarding our services
• credit card information to make payments for invoices using our payment processor 
• photos for job applications submitted through our websites  
• personal information we gather from other sources, such as publicly available databases and joint marketing partners

We only use your personal information for the purpose of contacting you, creating your account with us, assessing or addressing your needs, improving our service and product offerings, and/or responding to your requests. Each of our entities (i.e., Secure Data, Inc., Secure Data Recovery, LLC, and Secure Data Software, LLC) may share your personal information with each other for any of these purposes.

Disclosure of Personal Information

We will share your personal information with third parties only in the ways described in this privacy policy. We do not sell your personal information to third parties.

Secure Data does not share your personal information with third parties, except for the purpose of providing you with our services. We may also share your personal information with third parties who provide services on our behalf to help with our business activities. These companies are authorized to use your personal information only as necessary to provide these services to us. For example, these services may include, but are not limited to:

• Fulfilling orders and delivering packages
• Payment processing
• Providing customer service
• Sending marketing communications
• Fulfilling subscription services
• Conducting research and analysis
• Providing cloud computing infrastructure

We may also disclose your personal information to other parties when we have your consent to do so or when you direct us to, for any purposes requested or permitted by you.

We also reserve the right to share information in order to prevent illegal activities or to aid in the investigation and prosecution of illegal activities as required by law and when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others. If Secure Data is involved in a merger, acquisition, or sale of all or a portion of its assets (other than to a Secure Data affiliate), you will be notified via email and/or a prominent notice on our websites of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.

User Access and Choice

We will retain your personal information for as long as your account is active or as needed to provide you with our current or future services and products. We will also retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

You have the opportunity to choose (opt-out) whether your personal information is (a) to be disclosed to a non-agent third party, or (b) to be used for a purpose other than the purpose for which it was originally collected or subsequently authorized by the individual. We will provide individuals with reasonable mechanisms to exercise their choices. However, you understand that if you do not provide all of the information that we request, we may not be able to provide you with some or all of our services or the quality of our services may be compromised (through no fault of our ours and without any liability).

Confidentiality and Security

Secure Data limits access to our customers’ personal information to our staff members and agents who need said information in order to provide requested services to you and your business. We may also share information at our discretion with reputable equipment manufacturers in the course of providing our services. These third-party service providers (such as manufacturers) are authorized to use your data diagnostics only as necessary to provide these services to us.

Secure Data may sign confidentiality agreements if requested; the terms of those agreements may reinforce this agreement but will not supersede this agreement unless they contain an explicit statement to this effect. We maintain a strict non-disclosure agreement, and all of our employees and vendors comply with this agreement.

Website Security

When you enter sensitive information (such as login credentials and credit card information) on our forms, we encrypt the transmission of that information using secure socket layer (SSL) Technology. We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, therefore we cannot guarantee its absolute security. Cookie Collection

Our websites use cookies to provide a better experience for visitors. Cookies are small files stored on your computer that allow websites to identify and differentiate between different users. Most websites use cookies in some way. Cookies are limited and do not allow us to access any files on your computer. You may delete cookies at any time by consulting your web browser’s documentation. You may also consult your browser's documentation if you do not wish to receive cookies or if you want to be notified when websites use cookies. If you turn off cookies, you may not be able to use certain functions and features of our websites.

Tracking and Analytics Technologies

As is true of most websites, we gather certain information automatically and store it in log files. This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data. We do not link this automatically-collected data to other information we collect about you.

Our websites may also use GoogleAnalytics, a popular web traffic analytics tool. Google Analytics adds cookies to your computer when you visit our websites and collects information about the website traffic. See Google's privacy policy for more information.

Secure Data and our third-party partners (marketing partners, etc.), affiliates, or analytics or service providers (online customer support providers, etc.) may use technologies such as cookies, beacons, tags, and scripts. These technologies are used in analyzing trends, administering the site, tracking users’ movements around the site, and gathering demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.

We may partner with a third party to either display advertising on our websites or to manage our advertising on other sites. Our third-party partner may use technologies such as cookies to gather information about your activities on this site and other sites in order to provide you advertising based upon your browsing activities and interests. When you download and use our services, we automatically collect information on the type of device you use, operating system version, and the device identifier (or “UDID”).

Mobile Analytics and Notifications

We send you push notifications from time-to-time in order to update you about any events or promotions that we may be running. If you no longer wish to receive these types of communications, you may turn them off at the device level. To ensure you receive proper notifications, we will need to collect certain information about your device such as operating system and user identification information.

We use mobile analytics software to allow us to better understand the functionality of our mobile software on your phone. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, and from where the application was downloaded. We do not link the information we store within the analytics software to any personally identifiable information you submit within the mobile application.

Information Related to Data Collected by our Clients

Secure Data collects information under the direction of its clients and has no direct relationship with the individuals whose personal data it processes. If you are a customer of one of our clients and would no longer like to be contacted by one of our clients that use our service, please contact the client that you interact with directly. We may transfer personal information to companies that help us provide our service. Transfers to subsequent third parties are covered by the service agreements with our clients. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct his query to the Secure Data’s client (the data controller). 

We will retain personal data we process on behalf of our clients for as long as needed to provide services to our clients. Secure Data will retain this personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

You may sign up to receive emails or newsletters or other communications from us. If you would like to discontinue receiving this information, you may update your email preferences by using the“Unsubscribe” link found in emails we send to you or by contacting us at https://www.securedata.com/contact.

Links to Third-Party Sites

Our site includes links to other websites whose privacy practices may differ from those of Secure Data. If you submit personal information to any of those sites, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any website you visit.

Testimonials

We display personal testimonials of satisfied customers on our site in addition to other endorsements. With your consent, we may post your testimonial along with your name. If you wish to update or delete your testimonial, you can contact us at https://www.securedata.com/contact.

Blogs

Our blog is managed by a third-party application that may require you to register to post a comment. We do not have access or control of the information posted to the blog. You will need to contact or login into the third-party application if you want the personal information that was posted to the comments section removed. Social Media Widgets

Our websites include social media features, such as Facebook and Twitter buttons and Widgets including the Share button and interactive mini-programs that run on our site. These features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the feature to function properly. Social media features and Widgets are either hosted by a third party or hosted directly on our site. Your interactions with these features are governed by the privacy policy of the company providing it.

Children

Our websites and service offerings are not directed toward individuals under the age of 18 (or the age of majority in the country in which they reside, if less than 18). We do not knowingly collect personal information from minors.

EU-U.S. Data Privacy Framework and Swiss-U.S. Data Privacy Framework

Secure Data complies with the EU-U.S. Data Privacy Framework and the Swiss-U.S. Data Privacy Framework as set forth by the U.S. Department of Commerce.  Secure Data has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework (DPF) Principles with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF.  Secure Data has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles with regard to the processing of personal data received from Switzerland.  If there is any conflict between this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the applicable Principles shall govern.  To learn more about the DPF program, and to view our certification, please visit https://www.dataprivacyframework.gov/.

Secure Data is responsible for the processing of personal data it receives, under the DPF, and any subsequent transfers to a third party acting as an agent on its behalf. Secure Data complies with the DPF Principles for all onward transfers of personal data from the EU and Switzerland, including the onward transfer liability provisions.

The Federal Trade Commission has jurisdiction over Secure Data’s compliance with the EU-U.S. DPF and Swiss-U.S. DPF.  In certain situations, Secure Data may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

In compliance with the EU-U.S. DPF and the Swiss-U.S. DPF, Secure Data commits to refer unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF and the Swiss-U.S. DPF to TRUSTe, an alternative dispute resolution provider based in the United States.  If you do not receive timely acknowledgment of your DPF Principles-related complaint from us, or if we have not addressed your DPF Principles-related complaint to your satisfaction, please visit https://feedback-form.truste.com/watchdog/request for more information or to file a complaint.  These dispute resolution services are provided at no cost to you.

For complaints regarding DPF compliance not resolved by any of the other DPF mechanisms, you have the possibility, under certain conditions, to invoke binding arbitration. Further information can be found on the official DPF website.

Changes to this Privacy Policy

Secure Data may change or update this privacy policy as needed. Most changes are for additional clarity and will not affect the quality of our services. We will notify you about significant changes by placing a notice on our websites or by sending you an email; however, we will provide such notice prior to the change becoming effective.
